GPhC Suspends Superdrug Pharmacist for Discriminatory Refusal to Dispense Gender-Affirming Hormone Therapy

Allegations:

  • The registrant, while working as the Responsible Pharmacist on 3 October 2024, was alleged to have failed to provide person-centred care by refusing to dispense Patient A’s prescribed medication: when the medication was clinically indicated; without a clinical reason and/or justification; without making enquiries of, or consulting with, Patient A’s prescriber and/or GP; without recording the decision.
  • The registrant allowed a junior member of staff to convey the registrant’s concerns and dispensing decision to Patient A.
  • The registrant’s conduct in refusing to dispense Patient A’s medication was discriminatory.
  • In a public area of the pharmacy, the registrant communicated views contrary to NHS guidance by indicating: disagreement with the COVID-19 vaccine; that the registrant would promote people not taking the vaccine.

Outcome: 6 month suspension

Case Summary

Allegations

This case concerned a community pharmacist acting as the Responsible Pharmacist and a refusal to dispense an established repeat prescription for feminising hormone therapy to Patient A, a transgender patient.

Patient A attended their nominated pharmacy on 3 October 2024 to collect a repeat NHS prescription that had previously been supplied through the pharmacy. The prescription comprised 60 capsules of progesterone 100 mg and 16 Estradot 100 microgram patches. Patient A had been receiving the treatment for approximately 18 months. The GP had issued the prescription following specialist input, with evidence before the Committee of a shared-care arrangement involving Patient A’s GP and consultant.
