Date of Decision: October 2, 2024

Case Summary
The GPhC Fitness to Practise Committee reviewed the case of a pharmacist, referred to here as “the registrant,” who faced allegations of inappropriate conduct towards a colleague, including sexually inappropriate behavior, physical misconduct, and subsequent harassment. This case highlights serious breaches of professional standards and workplace ethics.
Allegations and Proven Findings
- Inappropriate Messaging and Behavior:
- On 3 January 2023, the registrant sent sexually inappropriate WhatsApp messages to a female colleague, referred to as Colleague A. These included comments such as, “Don’t sit next to me…you turning me on.”
- Physical Misconduct:
- On the same day, the registrant squeezed Colleague A’s buttock while she worked in the dispensary.
- Retaliation and Harassment:
- After Colleague A reported the misconduct to the employer, the registrant engaged in retaliatory behavior. This included making intimidating remarks like “What the fuck are you talking about all this time” and publicly suggesting a patient was Colleague A’s romantic partner.
- Admissions and Proven Findings:
- The registrant admitted to some of the allegations and disputed others. The Committee found most allegations proven, including those of sexual motivation and harassment.
Fitness to Practise Findings
The Committee determined that the registrant’s actions:
- Compromised Workplace Safety: Inappropriate and retaliatory behavior undermines the safety and integrity of the professional environment.
- Broke Fundamental Professional Standards: The behavior demonstrated a lack of respect, professionalism, and judgment.
- Undermined Public Confidence: Such conduct from a pharmacist impacts public trust in the profession.
While the registrant expressed some remorse, the Committee found their reflective statements insufficient in demonstrating a full understanding of the seriousness of their actions.
Outcome and Sanctions
The GPhC imposed a 12-month suspension with a review before potential reinstatement. The suspension reflects the need to:
- Protect the public and maintain confidence in the pharmacy profession.
- Allow the registrant time to reflect, complete remediation, and demonstrate genuine insight.
