Case Summary

Allegations
The case involved serious concerns regarding the registrant’s repeated and unjustified access to patient information. Specifically, over a four-month period between 13 March 2024 and 16 July 2024, the pharmacist accessed the electronic health records of sixteen vulnerable patients a total of 388 times via the Derbyshire Summary Care Record (DSCR) system. Crucially, there was no clinical need or other legitimate reason for these accesses. The sheer volume and nature of this conduct raised significant concerns about the registrant’s professional judgement, respect for patient confidentiality, and overall behaviour in line with GPhC expectations.

The case was particularly troubling due to the vulnerable nature of the patients involved and the clear breach of trust such actions represent. Although the records in question were accessible through the DSCR system, the ethical and legal boundary of only accessing them for legitimate clinical purposes was clearly crossed.

Findings
The GPhC’s Investigating Committee determined that the allegations were substantiated and represented serious misconduct. They acknowledged that the misconduct occurred during a period of personal and health-related difficulties for the registrant. However, the panel emphasized that even in such circumstances, the duty to maintain patient confidentiality remains absolute.
