Case Summary

In a recent determination by the General Pharmaceutical Council’s Fitness to Practise Committee, a pharmacist was removed from the register following a conviction for fraud by abuse of position and being concerned in supplying a controlled drug. The hearing, held remotely on April 13-14, 2023, found the pharmacist’s fitness to practise impaired due to these convictions.

Allegations
The pharmacist faced allegations of fraud by abuse of position and involvement in the supply of a controlled drug, following a guilty plea. These actions were contrary to sections of the Fraud Act 2006 and the Misuse of Drugs Act 1971.

Findings
The Committee found that the pharmacist had been coerced into supplying over 2000 bottles of codeine linctus and Phenergan to unknown individuals, who threatened his family. Despite the coercion, the pharmacist continued these activities over a significant period without reporting the threats to his employer or the police until confronted.

GPhC Determination on Impairment
The Committee determined that the pharmacist’s conduct presented a risk to the public and brought the profession into disrepute. The pharmacist breached several GPhC standards, including failing to work in partnership with others, not speaking up when things went wrong, and not demonstrating leadership.

Sanction
Considering the seriousness of the convictions, the Committee concluded that removal from the register was the only appropriate sanction. This decision was made to protect the public, maintain confidence in the profession, and uphold professional standards.
