Pharmacist Suspended After Cannabis Drug-Driving Conviction and Dishonest GPhC Declarations

Allegations:

  • The registrant was convicted at Bolton Magistrates’ Court on 26 March 2024 after driving a motor vehicle on 22 September 2023 with cannabis in their blood at 3.2 micrograms per litre, exceeding the specified legal limit of 2 micrograms per litre.
  • The registrant failed to declare that conviction to the GPhC within seven days, as required under Rule 4(2)(a) of the General Pharmaceutical Council Fitness to Practise and Disqualification Rules.
  • On or around 11 December 2023, when completing their GPhC registration application, the registrant incorrectly answered “no” to a question asking whether they were under investigation by any regulatory body or criminal enforcement authority.
  • The response in allegation 3 was dishonest because the registrant knew they had been stopped by police for alleged drug driving, knew the answer was incorrect, and intended to mislead the GPhC into believing they were not under investigation.
  • On or around 18 November 2024, when completing their GPhC registration renewal declaration, the registrant incorrectly answered “Yes – previously informed” to a question about whether they had previously been convicted or cautioned for a criminal offence.
  • The response in allegation 5 was dishonest because the registrant knew they had not previously informed the GPhC about the conviction, knew the answer was incorrect, and intended to mislead the GPhC into believing the conviction had already been declared.

Outcome: Suspended from the register for 4 months

Allegations

This case concerned a pharmacist who appeared before the GPhC Fitness to Practise Committee following a criminal conviction and subsequent dishonest declarations made to the regulator. The events began before the registrant joined the pharmacist register, while they were a pre-registration pharmacist.

On 22 September 2023, the registrant was stopped by police while driving a BMW on the A666 St Peters Way in Bolton. Officers noticed a strong smell of cannabis coming from the vehicle. A roadside drugs test was carried out and returned a positive result for cannabis. The registrant was then taken to Bolton police station, where two blood samples were obtained for analysis. The analysis showed cannabis at 3.2 micrograms per litre of blood, above the legal specified limit of 2 micrograms per litre.
