Pharmacist’s Fitness to Practise Impaired Due to Misconduct and Conviction

In a recent determination by the General Pharmaceutical Council (GPhC), a pharmacist faced a review hearing due to allegations of misconduct and a conviction for possession of Cannabis. The pharmacist had previously been suspended for misconduct and failed to disclose his conviction to the GPhC, as required by the rules. The Committee found that the pharmacist’s fitness to practise remained impaired, citing concerns about public confidence and professional standards.

During the hearing, it was revealed that the pharmacist had been arrested for possession of Cannabis and subsequently convicted. Despite being required to inform the GPhC of his conviction, he failed to do so. This non-disclosure, along with his previous misconduct, led to a suspension order being imposed.

The GPhC’s determination on impairment highlighted the pharmacist’s lack of engagement with the regulatory process and failure to provide evidence of remediation or insight into his actions. The Committee emphasized the importance of maintaining public confidence in the profession and protecting patients.

As a sanction, the Committee decided on a further suspension of nine months, allowing the pharmacist time to demonstrate remediation and engage with the process. The Committee noted that continued non-engagement could lead to removal from the register.

For pharmacy professionals, this case underscores the critical importance of transparency with regulatory bodies and the need for ongoing engagement and remediation following any findings of impairment.
