Pharmacy Technician Suspended for Dishonest GPhC Disclosure Following Common Assault Conviction

Allegations:

  • On 19 May 2023, the registrant incorrectly answered “no” on an application to return to the GPhC register when asked whether they were currently, or had ever been, under investigation by a regulatory body or criminal enforcement authority.
  • Between 8 May 2023 and 23 June 2024, the registrant failed to notify the GPhC of: A police investigation; Criminal proceedings; A criminal conviction.
  • The registrant’s incorrect declaration and failures to disclose were alleged to be dishonest because: The registrant knew they had been investigated, were facing criminal proceedings and had been convicted; The registrant knew that information relating to fitness to practise and criminal investigations had to be disclosed to the GPhC within seven days; The registrant knew that Rule 4(2)(a) of the General Pharmaceutical Council (Fitness to Practise and Disqualification etc. Rules) Order of Council 2010 required a conviction to be reported within seven days; The registrant sought to conceal the police investigation, criminal proceedings and conviction from the GPhC.
  • On 2 August 2023, the registrant was convicted at Snaresbrook Crown Court of common assault, contrary to section 39 of the Criminal Justice Act 1988.

Outcome: Suspended from the register for 10 weeks

Allegations

This case concerned a pharmacy technician’s obligation to be open and honest with the professional regulator. It did not arise from a dispensing error, clinical decision, controlled drug incident, medicines-management failure or direct patient-safety event. Instead, the central issue was whether the registrant had deliberately withheld information about a police investigation, criminal proceedings and a subsequent conviction when applying to return to the GPhC register.

The relevant chronology began with police attendance at the registrant’s home in July 2022. The registrant was later taken into custody and interviewed under caution in September 2022. On 8 May 2023, the registrant was charged with a criminal offence.
