Pharmacy Technician’s Suspension Ends After Dishonest Non-Disclosure of Police Investigation and Conviction

Allegations:

• On 19 May 2023, the registrant submitted an application to return to the GPhC register and incorrectly answered “no” to a question asking whether they were, or had ever been, under investigation by a regulatory body or criminal enforcement authority.
• Between 8 May 2023 and 23 June 2024, the registrant failed to declare to the GPhC: a police investigation; criminal proceedings; and a criminal conviction.
• The registrant’s conduct in making the inaccurate declaration and/or failing to disclose the investigation, proceedings and conviction was found to be dishonest. The Committee found that the registrant: knew they were under investigation, facing criminal proceedings and had subsequently been convicted; knew relevant fitness-to-practise and criminal investigation information had to be disclosed to the GPhC within seven days; knew a conviction had to be disclosed within seven days under Rule 4(2)(a) of the GPhC Fitness to Practise and Disqualification etc. Rules; and sought to conceal the police investigation, criminal proceedings and/or conviction from the regulator.
• On 2 August 2023, the registrant was convicted at Snaresbrook Crown Court of common assault contrary to section 39 of the Criminal Justice Act 1988.

Outcome: Fitness to practise was no longer impaired.
